Terms of Service

1. Agreement to Terms

By scheduling, authorizing, or receiving services from NTS Pool Services ("NTS," "we," "us," or "our"), you ("Client") agree to these Terms of Service. These terms constitute a binding agreement under California law.

2. Services

NTS Pool Services provides pool and spa cleaning, maintenance, repair, and related services as agreed upon at the time of scheduling. Scope of work will be communicated prior to or at the time of service. We reserve the right to decline or discontinue service at our discretion.

3. Scheduling & Access

The Client is responsible for ensuring NTS has safe, unobstructed access to the pool or spa on the scheduled service date. This includes controlling pets and unlocking gates or access points. If our technician cannot access the property, the visit will be treated as a cancellation subject to the policy in Section 5.

4. Payment Terms

Payment is due upon completion of service unless otherwise agreed in writing. NTS reserves the right to suspend service on any account with an outstanding past-due balance.

5. Cancellations & Rescheduling

We ask for at least 24 hours' notice for cancellations or rescheduling. Repeated no-shows or late cancellations may result in termination of recurring service.

6. Chemical & Water Quality Disclaimer

NTS Pool Services will balance water chemistry to industry-standard levels at the time of each service visit. However, water chemistry can change rapidly due to weather, bather load, debris, and other factors outside our control. NTS is not responsible for water quality issues that arise between scheduled visits, or issues resulting from the Client adding chemicals, equipment, or substances to the pool without our knowledge. We recommend Clients do not alter water chemistry between service visits without consulting us first.

7. Equipment & Pre-Existing Conditions

NTS will notify the Client of any equipment issues or pre-existing conditions observed during a service visit. We are not responsible for damage to or failure of equipment that was already in a deteriorated, faulty, or non-standard condition prior to our service. Any repairs or replacements recommended by NTS that the Client declines are done so at the Client's own risk.

8. Limitation of Liability

To the fullest extent permitted by California law, NTS Pool Services' total liability for any claim arising out of or related to our services shall not exceed the total amount paid by the Client for the specific service giving rise to the claim. NTS is not liable for indirect, incidental, consequential, or punitive damages of any kind.

9. Property Damage

NTS takes reasonable care when performing services on your property. In the unlikely event our technician causes damage, the Client must notify NTS in writing within 72 hours of the service visit. Claims reported after this window may not be considered. NTS carries general liability insurance and will work in good faith to resolve valid claims.

10. Photography & Documentation

NTS Pool Services may photograph or document pool and equipment conditions before and after service for quality control, record-keeping, and marketing purposes. By agreeing to these terms, the Client grants NTS Pool Services permission to use these images on our website, social media, and other marketing materials. Images used publicly will not include identifying information such as your name or street address without your explicit written consent. The Client may opt out of marketing use at any time by notifying us in writing.

11. Termination of Service

Either party may terminate recurring service with written notice. NTS reserves the right to immediately terminate service in cases of non-payment, unsafe conditions, or abusive conduct toward our staff. The Client remains responsible for any outstanding balance at the time of termination.

12. Governing Law & Disputes

These Terms of Service are governed by the laws of the State of California. Any disputes arising from this agreement shall first be attempted to be resolved informally by contacting NTS directly. If unresolved, disputes shall be handled in Fresno County, California. In accordance with California Civil Code, nothing in these terms waives any consumer rights the Client is entitled to under California law.

13. Changes to These Terms

NTS Pool Services reserves the right to update these Terms of Service at any time. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
